In accordance with the Data Protection regulation and its procedural legislation, the web site situated in URL www.jscommission.com, belonging to JS Commission Ltd. is especially interested and concerned about the safeguarding of the rights of the USERS and AGENTS who render or provide their personal data in a free and voluntary fashion in order to request certain services.
JS Commission Ltd., owner of the Gateway and considered as the Company Responsible for the files, guarantees complete and full adherence to the obligations set forth in the General Public Act of Parliament 2001 for the Protection of Personal Data, and those obligations set out in the IEEE/2001. This page defines the use and treatment which should be given to personal data obtained through the corresponding registration forms.
Modification of the Privacy Policy:
JS Commission Ltd. reserves the right to modify the Privacy Policy to adapt it to the possible legislative and jurisprudential novelties which may occur in the subject area of the protection of data, as well as the practices of the Internet industry. Registering of Personal Data:

The data collected using the corresponding formulas are not communicated to any third party or to any company or organisation.
Files / Documents:
The User or AGENT is informed of and gives his consent for the treatment of his personal data, for this data to be entered into a file which is duly protected and registered with the Data Protection Agency. In order to adequately complete the register as a User or AGENT it is necessary for the applicant to reply to all the compulsory data. The User or AGENT , will not be registered as such in the case that he does not reply to one of the compulsory fields which are marked with an asterisk in the question form.
By accepting this policy, the User or AGENT gives his consent for the sending, by traditional and electronic means, of the technical operative and commercial information requested about the products and services offered by JS Commission Ltd. Responsibilities:

JS Commission Ltd. is a commercial company, whose purpose is to offer services for buying, selling and renting of estate properties linked both to persons and to companies from the real estate sector. All these services are offered through the internet Gateway.
The jscommission.com Gateway has been made, created and designed by JS Commission Ltd., and its purpose is to present and to facilitate information about estate properties, subject to the restrictions and limitations of the current General Conditions, as well as to allow and to make possible access to other pages which the Gateway has established commercial, professional and other relations with. The use of the domain name jscommission.com which has been duly registered by JS Commission Ltd., with all guarantees, has been suitably communicated to the Mercantile Register, as according of Goverment Rules and Regulations, which deals with Information Society Services and Electronic Commerce. It is made clear that the current General Conditions are fully adequate according to the current regulations on Data Protection, Electronic Commerce, Contracting Conditions, Intellectual Property and subsidiary provisions.
1. ACCESS TO THE Gateway:
The use of the jscommission.com web implies that the User has fully accepted all the Conditions, whether these conditions be General Conditions or Specific Conditions for each particular case. For this reason, if the User does not agree with the content of the conditions he should abstain from using the Gateway and the products and services which are set out therein.
Some of the services offered on the Gateway, are subject to certain own Particular conditions, which according to each particular case, substitute, complete and/or modify the current General Conditions. The access and/or the use of the aforementioned services and contents implies the complete and unconditional acceptance of the General Conditions in the version which is published by JS Commission Ltd. at the time when the access and/or use takes place.
2. MODIFICATION OF THE Gateway:
JS Commission Ltd. reserves the right to make those changes which it deems appropriate, and can, unilaterally and without prior notice, modify, delete and include any new content and/or services, and the form in which this content and/or services appear, are presented and localized.
In the same way, the Member also accepts that JS Commission Ltd. reserves the right to modify, and to update periodically the current Conditions of Use, and the specific conditions for each service. Except in the case that the opposite is agreed, the introduction of any characteristic which modifies the current services or the introduction of any new services, will again imply adherence to the current General Conditions.
3. OBLIGATIONS FOR THE CORRECT USE OF THE Gateway AND THE CONTENTS:
The User is obliged to:
Recognise and accept that access to the Web Site and the contents included therein, takes place freely and consciously, under his/her exclusive responsibility.
Not to use the services to carry out any activity which is prohibited by the law, by morality, by public order, and in general to make a legitimate and honourable use of the services according to these General Conditions. In this sense, it is absolutely prohibited to manipulate or alter the current website without the deliberate written agreement of the contracting holder. Any alternation, modification or manipulation without the agreement of the contracting holder, exempts the proprietor JS Commission Ltd. of all responsibility.
To abstain from reproducing or copying, distributing, allowing public access in any form, transforming or modifying the contents, except when holding compulsory authorisation of the contracting holder of the corresponding rights or in the case that this is legally permitted; to delete, elude or manipulate the "Copyright" and other data which identify the rights of JS Commission Ltd. or its incorporated contracting holders for the contacts, for the technical devices for protection of for any information mechanism which could contain these contents. In this way, the User will abstain from carrying out any act which could damage, render useless, overload or deteriorate the Gateway, and the services and/or impede the normal use and utilisation by the rest of the Users.
The User is obliged not to use the Gateway or its services and contents, contrary to the current Conditions, or in default of this contrary to the legislation in vigour at the time of application.
So as to enunciate, but under no circumstances to limit or to exclude, User is obliged:

Not to introduce or to disseminate contents or propaganda with racist, xenophobic, pornographic characteristics, or which defend of terrorism or which attempt to take away human rights, public liberties, honour, intimacy or self image.
Not to transmit publicity which has not be authorised or requested, or publicity material, or any other type of request, except in the areas which are designated for this purpose.
4. OBLIGATIONS OF JS Commission Ltd.:
It will be the obligation of the Gateway, to maintain the web site with acceptable quality standards within the usual uses of Internet, which implies ensuring that it is possible to enjoy the services without interruption caused by technical reasons. In any case, the system is not fault free, and the Gateway will attempt, to solve any incidences which occur, as in the shortest time possible, according to the state of the technology. The Gateway reserves to right to temporarily suspend the services so as to carry out any repairs or updates of the Gateway or any of the services individually.
Moreover, it will be the obligation of JS Commission Ltd. to supply the User with the services which he has subscribed to, under the terms laid out in the General Conditions or according to the specific conditions of each type that the User subscribes to, and also to reply to the complaints of the Use as soon as possible.
JS Commission Ltd. acquires the obligation, amongst others, to take care of professional secrecy, confidentiality of data and information which they have acquired due to, their position, and to protect the interest of the Users, etc.
5. FUNCTIONING OF THE SERVICE:
JS Commission Ltd. does not guarantee the availability or the continuity of the Web Site, neither does it accept responsibility for any damages which occur or may occur in the future, neither does it accept responsibility for technical defects, whatever be the nature of these defects, which are derived from the use of the information and the material which are contained in the jscommission.com. Website.
JS Commission Ltd. will not be responsible for the faults which may be produced in communications including the deletion, incomplete transmission or delays in resending, neither do they guarantee that the transmission network be operational at all times. Neither will JS Commission Ltd. be answerable in the case that a third party, who breaks the means of security established by JS Commission Ltd., access the messages or use them to send out any computer virus.
JS Commission Ltd. will be solely and exclusively responsible for the services which it provides in its own right, and for the contents which originate directly from the company and which are identified by its Copyright. This responsibility will be excluded in the cases of force majeure or if the configuration of the User equipment is not adequate enough so as to allow the correct use of the Services which are provided.
As far as the services are concerned, it is necessary to point out that all of them are presented according to the current Law 34/2002, dated 11 of July, which deals with Information Society Services and Electronic Commerce. In the case of expressed acceptation by the User that he be sent the information bulletin "PropertyPulse" this will be clearly indicated by the inclusion of the word "publicity" and will indicate the name of the person or legal person.
Not withstanding the previous clause, the User expressly accepts that the Gateway uses his personal information, to improve commercial and promotional incentives, to analyse the pages of the Gateway which are visited most frequently, to perfect the offers and the publicity of contents and products, and to personalize these contents, presentation and services. These ends will perfect the Gateway, and will adapt it to their requirements, so that it is easier to reply to their needs.
6. CONTENTS OF THE Gateway:
JS Commission Ltd. will not be responsible for legality, reliability, and usefulness of the contents, neither for their truth, exactness, exhaustiveness and/or for them being up to date. JS Commission Ltd., excludes any responsibility for any damages of whatever nature which could arise due to the transmission, dissemination, storing, making available, reception, obtaining or access to contents, as well as for the damages which could be due from:

Infractions of the rights of Intellectual and Industrial Property, of professional secrets, and contractual obligations of any type that have been acquired.

JS Commission Ltd. will not be responsible for any damages caused by the presence of viruses or any other harmful elements which could alter the computer system belonging to the User. By way of expository note, but not limited thereto, JS Commission Ltd. will not be responsible for damages caused of any nature, either directly or indirectly to the User as a consequence of the use or impossibility to use the services which are contained in the Gateway, in cases of force majeure or fortuitous cases.
The contents which are come from internal sources in JS Commission Ltd. are duly identified with their Copyright. JS Commission Ltd. reserves the permission to make modification of these, including modifications in the conditions of access, without having to give previous warning. JS Commission Ltd. will respond solely and exclusively to the contents which are identified with their Copyright.
It is possible that contents which come from sources external to JS Commission Ltd. may not be up to date or accurate. In the case that JS Commission Ltd. becomes aware of this, they will do all that is reasonably possible so that these contents are updated and rectified. JS Commission Ltd. does not accept any responsibility for these contents, as this responsibility belongs to the person who has emitted these contents.
7. EXCLUSION OF RESPONSIBILITY FOR THE SERVICES AND CONTENTS:

Not withstanding the previous clause JS Commission Ltd. will be able to interrupt the service or to immediately resolve the relationship with the User if JS Commission Ltd. detects use of the web site or any or the services offered in this contract which is contrary to the current General Conditions.
In the same way JS Commission Ltd. is exonerated from any type of responsibility, of no matter what nature or condition, which arises from the comments and opinions given on the web site by the Users of it.
8. RESPONSABILITY FOR DAMAGES:
The User shall respond to damages of any nature which JS Commission Ltd. suffers as a consequence of breaching any of the obligations to which he is obliged to carry out according to the General Conditions.
If the Gateway were to suffer any type of complaint related to the current General Conditions, the User is obliged to free the Gateway from this. The User is also to pay the costs and to compensate the Gateway immediately as required, for all expenses, costs, damages and losses of any type (including the fee for lawyers and for solicitors, even if their intervention is not compulsory) that the Gateway may be liable for as a consequence of any claim, be this current or imminent, of any type, for violation of the rights of industrial or intellectual property, lack of payment of any of the amounts due, or any other intellectual property rights, calumny, libel, breach of confidentiality, revealing of secrets, breach of any duty of confidentiality, breach of any legal or regulation duty, illegal publicity, false or misleading publicity, etc.
9. HIPERLINKS AND LINKS:

Under no circumstances can JS Commission Ltd. assume the responsibility for the contents of any of the links which belong to a foreign site. 10. INDUSTRIAL AND INTELLECTUAL PROPERTY:
The User recognises that all elements of the jscommission.com web site and each one of the services presented by JS Commission Ltd. such as the information and materials contained therein, the structure, selection, sorting and presentation of the contents, programs and development of programs used in relation to these are protected by the rights of intellectual and industrial property of the jscommission.com web site or of third parties.
Under no circumstances, access to these services, or use of them by the User, will imply any type of relinquishment, transmission or cession, be it either total or partial of these rights, nor does it give any right to use, to alter, to exploit, to reproduce, to distribute or to publicly communicate these contents without previous deliberate specific authorization given for this purpose by JS Commission Ltd. or by the third party of the rights in question. It is prohibited to use them, to download them permanently, to copy them or distribute them using any means, without the previous consent of the holder.
The content in jscommission.com cannot be neither totally nor partially reproduced, nor transmitted, nor registered in any information recuperation system, in any form or by any means, unless with the previous written authorisation, of the cited company or organisation.
It is also prohibited to delete, elude, or manipulate the "copyright" and other data which identifies the rights of JS Commission Ltd., and the technical devices for protection or any other mechanism of information which could contain the contents.
11. VIOLATION OF THE RIGHTS OF INTELLECTUAL PROPERTY:
In the case that any User of third party considers that any of the contents have been put onto the Gateway and in so doing have violated the rights of Intellectual Property, they must send notification to JS Commission Ltd., containing the following information:
Personal data: name, address, telephone number and e-mail address of the claimant.
Original signature or equivalent, with the personal data of the holder of the rights of intellectual property which have supposedly been infringed or the data of the person who is authorised to act in the name of or on behalf of the holder of the rights of intellectual property which have been infringed. The authorised person must produce the entitlement or accreditation that s/he represents the aforementioned rights.
To precisely and completely indicate the Contents which are protected through the rights of Intellectual Property which have supposedly been infringed, as well as indicated the place where the aforementioned contents can be found on the Gateway.
An expressed declaration, which is clear and under the responsibility of the claimant that the information given in the notification is exact and that the utilisation of the contents constitutes violation of his/her Intellectual Property rights.

12. DATA PROTECTION:
To access and/or use some of the Services it is necessary that the Users previously give JS Commission Ltd. certain data of personal nature (hereafter, "Personal Data") which JS Commission Ltd. will automate and incorporate in an automated file, which will be registered with the Agency for the Protection of Data, for each of the suitable ends. All these circumstances will be previously duly adverted JS Commission Ltd. to the Users, in the cases and in the way that can be legally demanded.
JS Commission Ltd. guarantees that it has adopted the necessary measures of security in its installations, systems and files. In this way JS Commission Ltd. guarantees the confidentiality of Personal Data, according to established law and their own internal policy.
Not withstanding this, JS Commission Ltd. will give the competent public authorities the Personal Data and any other information within its power or can be accesses thought the systems, and is required according to the legal orders and rules applicable to the case. The Users guarantee and respond, in any case, to the truth, exactness, being up to date and the authenticity of the Personal Data which has been facilitated, and promise to keep this data up to duly up to date.
At all times both the General Public Act of Parliament Law on the Protection of Data of a Personal Character, and the Royal Decree about security methods of Electronic Files of Personal Data and other legal norms to this effect in about the Protection of Data.
13. DURATION AND RESOLUTION:
Supplying the services and/or contents of the Gateway is of indefinite duration. Not withstanding the previous clause, JS Commission Ltd. is authorised to terminate, suspend, or unilaterally interrupt the service of the Gateway and/or any of the services, without the need for previous warning, without prejudice to the corresponding Specific Conditions.
14. FORCE:
Neither of the Parties will assume the responsibility for the non-carrying out or delay in carrying out any of the respective obligations contracted in virtue of the current Terms and Conditions and of the services presented by JS Commission Ltd., if this lack of performance or delay were the consequence of a case of Force Majeure or a fortuitous case admitted as such by case law, in particular: natural disasters, faults in the transmission of IP Packets, war, state of siege, changes to public order, strikes of public transport, cuts in electric power supply or any other exceptional measure adopted by the legal or administrative authorities.
15. INDEPENDENCE OF THE PARTIES:
JS Commission Ltd. and the User are independent parties and neither party is authorise to assume the obligations in name of the other. The relationship between the parties is bases solely and exclusively on the points in this contract.
None of the points of these current General Conditions, shall be considered as creating a company, joint company or agency between the Parties. The present Terms and Conditions do not establish the creation of a company, commercial company, agency, sales representation or employment relationship between the parties.
16. COMMUNICATIONS:
All notifications and communications by the User of the Gateway will be considered to have been carried out correctly, if they are carried out using the means at the disposal of the Gateway Users. The Gateway will communicate with its Users by electronic mail which figures in the data of the User register.
17. CONFIDENCIALITY:
All information which either of the parties communicate or facilitate to the other or to which they do not have access, will be considered as confidential and cannot be divulged, shown, reproduced, copied, discussed with third parties, or employed by either of the parties for ends which are foreign to the parties.
As a consequence, the Parties are obliged:
Not to divulge Confidential Information, and to assure security in a general way by adopting the all means that they judge to be useful;
To only communicate Confidential Information to their employees, who because of their function, need to use the services; and
To inform the employees of the confidential character of the information.
This Confidentiality obligation should be maintained during the time that the current agreement is in vigour, and afterwards, for a minimum period of at least two years.
